1. General Information

This website and online marketplace platform (“Platform”) is operated by Eurozammen, a business established in Germany and registered in Schongau.

By accessing, registering for, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions and all related policies published on the Platform.

If you do not agree with these Terms, you must not use the Platform.

2. Scope of Application

These Terms apply to all users of the Platform, including visitors, customers, businesses, and registered sellers.

Personal data is processed in accordance with our Privacy Policy.

3. Nature of the Platform

Eurozammen is an online marketplace and business directory that connects businesses and customers within the European Union.

Eurozammen acts solely as an intermediary platform and is not the seller, reseller, manufacturer, distributor, importer, or contracting party for products offered by sellers.

Sellers operate independently, in their own name and on their own account, and remain solely responsible for:

  • Product quality and safety
  • Product descriptions and pricing
  • Compliance with applicable laws
  • Shipping and delivery
  • Customer support
  • Returns and refunds
  • Tax obligations

Only products manufactured within the European Union may be offered on the Platform.

4. Platform Use

4.1 Marketplace Model

Businesses may create an online store and sell products directly through the Platform.

For Marketplace sellers:

  • No subscription fee applies
  • A 7% commission is charged on completed sales
  • Payments are processed through independent licensed payment service providers

Eurozammen is not a party to any transaction between buyers and sellers.

4.2 Catalog Model

Businesses may use the Platform to present their company, products, or services and redirect customers to their own websites.

For Catalog users:

  • No commission is charged
  • Subscription plans may be introduced in the future
  • Until subscription plans become available, catalog use may remain free of charge

Any future subscription fees will be communicated before taking effect.

4.3 Seller Terms and Compliance Obligations

All registered sellers must comply with the Seller Terms & Responsibilities, which form an integral part of these Terms and Conditions.

This includes compliance with all applicable requirements concerning product safety, consumer protection, taxation, packaging, packaging waste, recycling and Extended Producer Responsibility (EPR) in every country in which the Seller offers or delivers products.

Sellers must provide all legally required registrations, identification numbers, declarations and supporting documents requested by Eurozammen.

Eurozammen may verify the information provided and may restrict sales in a particular country, remove affected listings, suspend a Seller’s account or take other proportionate action where the required information is missing, inaccurate, expired or cannot reasonably be verified.

5. Orders, Payments, Returns and Consumer Rights

5.1 Payment Methods

Depending on availability, customers may pay using:

  • PayPal Marketplace
  • Stripe Connect
  • Bank Transfer
  • Credit and Debit Cards
  • Other payment methods provided by integrated payment providers

Available payment methods may vary depending on location, seller settings, and provider availability.

5.2 Payment Disclaimer

All payments are processed by independent third-party payment providers.

Eurozammen does not store payment card information and is not responsible for payment processing, banking failures, chargebacks, payment disputes, technical interruptions, or delays caused by payment providers.

5.3 Right of Withdrawal

Consumers have the right to withdraw from a purchase within 14 days from receiving the product, in accordance with applicable European Union consumer protection laws.

To exercise this right, customers must contact the seller directly.

5.4 Refunds and Returns

Refunds, returns, exchanges, complaints, and warranty claims are handled exclusively by the seller.

Each seller must provide:

  • A clear return policy
  • Cancellation instructions
  • Refund procedures
5.5 Withdrawal Exceptions

The right of withdrawal may not apply to:

  • Personalized products
  • Perishable goods
  • Sealed goods unsuitable for return for hygiene reasons
  • Digital content once delivery has begun

Sellers are required to comply with Directive 2011/83/EU and all applicable consumer protection legislation.

6. Shipping and Delivery

Shipping methods, delivery times, shipping costs, tracking information, and logistics services are determined and managed exclusively by the seller.

Eurozammen is not responsible for shipping performance, delivery delays, lost parcels, customs procedures, or logistics services.

7. Age-Restricted Products

Certain products may be subject to legal age restrictions.

By placing an order, customers confirm that they meet all applicable legal age requirements.

Eurozammen reserves the right to cancel orders or remove listings that violate age restriction requirements.

8. Accessibility

Eurozammen is committed to ensuring digital accessibility for all users, including individuals with disabilities.

We continuously improve accessibility and usability in accordance with applicable standards and best practices.

9. Intellectual Property

All content published on the Platform, including logos, trademarks, graphics, design elements, text, software, and website content, is the property of Eurozammen or its licensors and may not be copied, reproduced, distributed, or used without prior written permission.

10. Prohibited Products and Activities

The following are prohibited on the Platform:

  • Illegal products
  • Counterfeit products
  • Stolen goods
  • Dangerous or prohibited goods
  • Products infringing intellectual property rights
  • Fraudulent, misleading, or deceptive listings
  • Products violating European Union laws or regulations

Eurozammen reserves the right to remove any content or seller account that violates these rules.

11. Content Moderation and Removal Rights

Eurozammen may remove, edit, suspend, restrict, or refuse any product listing, seller profile, image, review, description, advertisement, or other content that:

  • Violates applicable law
  • Violates Platform policies
  • Infringes intellectual property rights
  • Creates safety risks
  • Damages the integrity or reputation of the Platform

Such actions may be taken without prior notice.

12. Seller Account Closure

Sellers may request closure of their seller account at any time.

Eurozammen may retain transaction records, invoices, accounting information, and legally required data for tax, fraud prevention, security, and legal compliance purposes.

Account closure does not remove obligations arising from previous transactions.

13. Limitation of Liability and Technical Availability

The Platform is provided on an “as available” and “as is” basis.

Eurozammen does not guarantee uninterrupted access, continuous availability, error-free operation, or compatibility with all devices and software environments.

Eurozammen shall not be liable for interruptions caused by:

  • Hosting failures
  • Server downtime
  • Software errors
  • Plugin conflicts
  • Cyberattacks
  • Security incidents
  • Internet provider failures
  • DNS issues
  • Maintenance periods
  • Third-party services
  • Payment provider disruptions
  • Force majeure events

To the maximum extent permitted by law, Eurozammen shall not be liable for:

  • Loss of profits
  • Lost sales
  • Business interruption
  • Reputational damage
  • Data loss
  • Indirect or consequential damages

Nothing in these Terms excludes liability where exclusion is prohibited by applicable law.

14. Termination

Eurozammen reserves the right to suspend, restrict, or terminate access to the Platform where users violate these Terms, applicable laws, or Platform policies.

15. Changes to the Terms

Eurozammen may amend these Terms at any time.

Updated versions will be published on the Platform and become effective upon publication unless otherwise stated.

16. Governing Law

These Terms shall be governed by the laws of the Federal Republic of Germany, together with all applicable mandatory provisions of European Union law.

Any disputes shall be subject to the jurisdiction of the competent courts in Germany, unless mandatory consumer protection laws provide otherwise.
