SELLER TERMS & RESPONSIBILITIES

1. Seller Status
Sellers operate independently and are not employees or agents of Eurozammen.

Sellers act in their own name and on their own account and are fully responsible for their products,

pricing, delivery, customer service, and compliance with EU laws and regulations.

2. Commissions and Subscription Fees

Sellers, merchants, suppliers, and service providers registered on Eurozammen agree to pay the applicable commission fees and/or subscription fees published on the platform. Eurozammen reserves the right to modify its fees at any time. Any changes will be published on the platform before taking effect.

The applicable fees may include:

A commission on completed sales transactions.
Monthly or annual subscription plans.
Additional optional service fees, where applicable.

By registering, listing products or services, or continuing to use the platform, sellers expressly accept the current fee structure published on Eurozammen.

Failure to pay applicable commissions, subscription fees, or other agreed charges may result in:

Suspension of seller privileges.
Removal of product or service listings.
Temporary or permanent account termination.
Recovery of unpaid amounts through legal means where permitted by law.

Eurozammen reserves the right to modify its fee structure at any time. Any changes will be communicated through the platform and will apply prospectively.

Current fees are published on the Eurozammen website and form an integral part of these Seller Terms & Responsibilities.

3. Legal Obligations
Sellers must comply with:
• EU consumer protection laws
• Product safety regulations
• Tax obligations
• Distance selling rules

4. Product Responsibility
Sellers are fully responsible for:
• Product accuracy
• Safety and compliance
• Warranty obligations

5. Pricing and Delivery
Sellers define their own:
• Prices
• Shipping costs
• Delivery terms

6. Payments

All payments on Eurozammen.eu are processed exclusively through independent licensed third-party payment service providers such as Stripe Connect, PayPal Marketplace, or other approved systems.

Eurozammen does not hold, receive, store, or manually process customer funds.

Customers complete payments securely using the available payment methods displayed at checkout.

Sellers receive payouts directly to their connected payment accounts subject to the terms, schedules, verification procedures, reserves, and compliance requirements of the selected payment provider.

Applicable marketplace commissions, transaction fees, processing fees, taxes, refunds, chargebacks, reserves, or provider charges may be deducted automatically before payout.

Sellers are solely responsible for maintaining accurate and active payment account details.

Eurozammen reserves the right to delay, suspend, freeze, reverse payouts, withhold commissions, restrict transactions, or request additional verification where fraud prevention, chargebacks, disputes, abuse, suspicious activity, legal obligations, sanctions screening, or compliance requirements arise.

Eurozammen is not responsible for payment provider outages, declined transactions, frozen accounts, delayed transfers, technical errors, provider policy changes, identity verification delays, or external payment disputes.

All payment relationships remain subject to the separate terms and conditions of the selected payment provider.

7. Customer Service
Sellers must handle:
• Returns
• Complaints
• Refunds

8. Violations
Eurozammen reserves the right to suspend or remove sellers.

Sellers are responsible for the accuracy of their product listings.
All products must comply with EU laws and regulations.

The platform reserves the right to remove listings that violate policies.

9. Seller Liability & Indemnification

Sellers agree to indemnify, defend, and hold harmless Eurozammen.eu, its owners, operators, affiliates, and representatives from any claims, damages, losses, liabilities, costs, legal fees, penalties, or disputes arising from:

• Products sold by the seller
• Product defects or safety issues
• False descriptions or misleading listings
• Intellectual property infringement
• Delivery failures or delays
• Consumer complaints
• Refund disputes
• Tax violations
• Breach of applicable laws
• Seller misconduct or negligence

10. No Liability of Platform

Eurozammen.eu shall not be liable for disputes between sellers and customers, product quality issues, shipment delays, refund claims, chargebacks, warranty claims, tax matters, regulatory breaches, or losses caused by seller actions.

To the maximum extent permitted by law, Eurozammen’s total liability shall not exceed the fees paid by the seller to Eurozammen during the preceding twelve (12) months.

11. Right to Immediate Suspension

Eurozammen reserves the right to suspend, restrict, freeze payouts, remove listings, or permanently terminate seller accounts immediately and without prior notice in cases of suspected fraud, policy violations, legal risk, abusive conduct, repeated complaints, or regulatory concerns.

12. Seller Tax Responsibility

Each seller is solely responsible for VAT, income tax, customs obligations, invoicing, accounting, and all tax compliance duties arising from their sales activities.

13. Intellectual Property Responsibility

Sellers confirm that they own or are authorized to use all product images, trademarks, descriptions, logos, and content uploaded to the platform.

Eurozammen is not responsible for seller copyright or trademark violations.

14. Seller Verification & Compliance

Eurozammen reserves the right to verify the identity, legal status, ownership, tax registration, address, payment details, and business legitimacy of any seller at any time.

Verification may include requests for:

• Government-issued identification
• Business registration documents
• VAT number confirmation
• Proof of address
• Bank or payout verification
• Product ownership or authorization proof
• Additional compliance information

Failure to complete verification may result in listing restrictions, payout delays, suspension, or permanent account termination.

Eurozammen may reject or remove sellers at its sole discretion where fraud risk, reputational risk, legal concerns, false information, or compliance concerns exist.

15. Packaging, Recycling and Extended Producer Responsibility (EPR)

Sellers are responsible for complying with all applicable European Union and national requirements concerning packaging, packaging waste, recycling and Extended Producer Responsibility (EPR) in every country in which they offer or deliver products.

Where required by applicable law, the Seller must:

The Seller must register with the relevant national packaging or producer register.
The Seller must participate in an authorised packaging recovery or recycling scheme.
The Seller must declare the types and quantities of packaging placed on the market.
The Seller must pay all applicable environmental, licensing and recycling fees.
The Seller must comply with applicable packaging design, labelling, recyclability, reuse and waste-reduction requirements.
The Seller must appoint an authorised representative where required.

Before offering packaged products to consumers through Eurozammen, the Seller must provide all applicable EPR or packaging registration numbers for every country in which the Seller intends to sell. The Seller must also certify that the packaging and packaged products offered comply with the applicable EPR requirements in those countries.

The Seller confirms that all information and documents supplied to Eurozammen are complete, accurate, valid and up to date. Any change affecting the Seller’s registration or compliance status must be reported to Eurozammen without undue delay.

Eurozammen may verify the information provided by the Seller using official registers, publicly available databases or supporting documents issued by competent authorities or authorised producer responsibility organisations. The Seller must provide additional reliable evidence of compliance upon request.

If the required information is missing, inaccurate, expired or cannot reasonably be verified, Eurozammen may:

prevent the Seller from offering products in the affected country.
remove or deactivate the affected product listings.
temporarily restrict or suspend the Seller’s account.
take any other proportionate action necessary to comply with applicable law.

The Seller remains solely responsible for all packaging, recycling and EPR obligations. Eurozammen does not register, report, pay environmental fees or fulfil EPR obligations on behalf of a Seller unless this has been expressly agreed in a separate written mandate.

This section applies in particular to obligations arising under Regulation (EU) 2025/40 on packaging and packaging waste and the applicable legislation of each EU Member State.

16. EU Business Establishment

Only businesses legally established within the European Union may register and sell on Eurozammen.

17. Platform Rights & Reputation Clause

Eurozammen reserves the right to take any reasonable action necessary to protect the platform, its users, reputation, operations, legal compliance, and commercial integrity.

18. Policy Updates

Eurozammen reserves the right to modify, update, amend, or replace this Seller Policy at any time. Updated versions will be published on the platform and become effective upon publication unless otherwise required by applicable law.

19. Force Majeure

Eurozammen shall not be liable for delays, interruptions, or failures caused by events beyond its reasonable control, including natural disasters, cyberattacks, internet outages, governmental actions, wars, labor disputes, or failures of third-party service providers.

20. Governing Law and Jurisdiction

This Seller Policy shall be governed by and construed in accordance with the laws of the Federal Republic of Germany.

Any dispute arising out of or in connection with this Seller Policy shall be subject to the exclusive jurisdiction of the competent courts of Germany, unless mandatory provisions of applicable law require otherwise.
